Convicted Driver

Record penalty pointer stays on road

Thu, 09 Feb 2006

A salesman from Manchester has been allowed to stay on the road despite clocking up a total of 31 penalty points on his driving licence.

Jeffrey Englander pleaded that a driving ban would have inflicted "exceptional hardship" on both him and his family.

The case highlights the right of motorists to take their case to court if dealt more than 12 penalty points – the number after which drivers are automatically banned.

In exceptional cases, where being banned from the road will significantly impact the livelihood of those involved, motorists can be granted an exemption. They can benefit from a convicted driver insurance policy.

"You have to be very, very humble, and the more humble you are, the more they can see you are sorry, the more chance you have of getting off," said Mr Englander after being given the all clear from magistrates in Salford.

"I'm just driving very, very carefully now. I don't need any more problems."

Jeanette Miller, Mr Englander's solicitor, said that she had never come across anyone with as many points against his name.
